Introduction

Welcome to the Terms of Service (these "Terms") for Bunta AI, a service of Thinkit Labs LLC ("Thinkit Labs," "Bunta," "we," "our," or "us"). These Terms govern your access to and use of our website, dashboard, integrations, and AI-powered voice agent services (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not understand or agree to these Terms, do not use the Services.

If you use the Services on behalf of a company or other entity, you represent and warrant that you are authorized to bind that entity to these Terms, and "you" includes both you and that entity.

Section 8 contains an arbitration clause and class action waiver. By agreeing to these Terms, you agree to resolve most disputes through binding individual arbitration and waive class action participation, subject to limited exceptions.

1. The Services

1.1 Service Overview

Bunta provides AI-powered voice agents designed to help businesses answer inbound calls, qualify leads, respond to common questions, book appointments, route communications, and generate call summaries and analytics.

1.2 Input and Output

When you use the Services, you may provide prompts, call scripts, recordings, business details, and other materials ("Input"). The Services may generate transcriptions, summaries, suggested responses, and other results ("Output").

You retain ownership of your Input and Output. We do not claim ownership of your business data. You grant us the rights needed to host, process, and use Input and Output to provide, secure, maintain, and improve the Services in line with these Terms and our Privacy Policy.

1.3 AI Limitations and Professional Advice

The Services use generative AI and are not error-free. Output may be inaccurate, incomplete, delayed, or inappropriate in some circumstances. You are responsible for reviewing Outputs before relying on them.

The Services are not legal, medical, financial, or other professional advice and are not a substitute for qualified professionals.

1.4 Communication and Consent Compliance

You are solely responsible for complying with laws applicable to calls, recordings, messaging, and telemarketing in each jurisdiction where you use the Services, including consent, disclosure, and opt-out requirements.

  • You must provide all disclosures required by law for AI-generated or recorded calls.
  • You must obtain and maintain all required consent records.
  • You must honor valid opt-out requests where required by law.

Calls handled by our AI voice agents are recorded and stored, and the AI voice agent announces at the start of each call that the call is recorded. This announcement is a compliance aid only; you remain solely responsible for determining whether it satisfies the consent and disclosure requirements applicable to your calls.

We may provide compliance-related features, but you remain solely responsible for lawful configuration and use of the Services.

1.5 No Emergency Services

The Services are not a replacement for emergency services. Bunta AI does not provide access to 911, emergency dispatch, or any equivalent emergency response system. In the event of an emergency, you and your callers must contact emergency services directly.

The AI agent may attempt to detect emergency situations described by callers and may attempt to route such calls to designated business personnel. This functionality is provided on a best-effort basis only, with no guarantee of accuracy, availability, or successful delivery. The AI agent may fail to identify an emergency, may misclassify the severity of a situation, or may be unable to reach the designated contact.

You, as the subscribing business, are solely responsible for:

  • Configuring appropriate emergency handling protocols within your account settings
  • Maintaining alternative communication channels for emergency situations
  • Instructing your customers and callers to contact 911 or local emergency services directly for life-threatening or time-critical situations

To the maximum extent permitted by law, Bunta AI disclaims all liability for any harm, injury, loss, or damage arising from a caller's reliance on the AI agent in an emergency, including but not limited to the failure to detect, route, or escalate an emergency call.

1.6 SMS and Messaging Services

Each subscribing business is registered with The Campaign Registry (TCR) as its own brand, with a dedicated A2P 10DLC campaign and a dedicated phone number. Bunta AI acts as the messaging service provider (CSP) that facilitates this registration and message delivery on the business's behalf. Each campaign is limited to transactional Customer Care, Account Notification, and Delivery Notification messaging — including appointment confirmations and reminders, service status updates, technician ETA and dispatch updates, and dashboard messages from business owners to their customers. Marketing and promotional messaging are not permitted on these campaigns and are gated at the product layer.

Carrier and regulatory compliance. Bunta AI facilitates compliance with TCR, CTIA, and carrier requirements for each business's brand and campaign. This includes opt-in confirmation, STOP and HELP keyword handling, business identification in compliance responses, and platform-level acceptable-use enforcement.

Templated content. AI-generated messages — including appointment confirmations, reminders, service status updates, and technician ETA and dispatch updates — are crafted and controlled by Bunta AI. We are responsible for the content of these templates.

Owner-typed dashboard messages. Subscribing businesses may type free-form customer-care messages to their own customers through the Bunta dashboard. These messages are sent under the business's own registered campaign and remain subject to the acceptable-use restrictions in Section 4 (Rights We Grant You; Restrictions) of these Terms. You are solely responsible for the content of any message you compose and send through the dashboard. You agree not to use the dashboard messaging feature to send marketing, promotional, bulk, unsolicited, fraudulent, harassing, or unlawful content, or any content that violates the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state-level regulations, or carrier acceptable-use policies. Bunta AI may filter, modify, or refuse to send messages that violate these terms, and may suspend or terminate accounts engaged in abusive or non-compliant messaging.

Indemnification. You agree to defend, indemnify, and hold Bunta AI harmless from any claim, fine, regulatory action, or carrier action arising from messaging content you compose and send through the dashboard, including but not limited to TCPA violations, opt-out failures, and carrier acceptable-use violations attributable to your content. This obligation survives termination of your account.

Opt-out mechanics. All messages sent through the platform support opt-out keywords (STOP, STOPALL, UNSUBSCRIBE, END, QUIT, CANCEL, REVOKE, OPTOUT) and HELP keyword handling. Opt-out requests are honored automatically at the platform level and cannot be overridden by the subscribing business.

2. Eligibility, Accounts, and Billing

2.1 Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement and can enter into a binding agreement.

2.2 Account Registration and Security

You must provide accurate, complete, and current account information and keep it updated. You are responsible for safeguarding account credentials and all activity under your account, including activity by your team members.

2.3 Subscriptions, Renewals, and Cancellation

Paid features are billed on a subscription basis as described in your plan. Unless otherwise stated, subscriptions renew automatically at the end of each billing period until canceled. You may cancel from your account settings.

2.4 Fees, Taxes, and Refund Policy

You agree to pay all applicable fees, usage charges, and taxes. Failure to pay may result in suspension or termination of access.

All billing, subscription management, and refund processing is handled through Stripe, our payment processor.

  • Monthly subscription fees are prorated upon cancellation. If you cancel mid-billing period, you will receive a prorated credit for the unused portion of that period.
  • One-time fees including setup fees, onboarding fees, and phone number provisioning fees are non-refundable.
  • Usage-based charges for consumed usage such as call minutes and SMS segments are non-refundable.

To request a refund, cancel your subscription from your account settings or contact support@bunta.ai. Prorated credits for monthly subscriptions are applied automatically. All refund requests are subject to Stripe's processing timelines.

2.5 Trials and Beta Features

We may offer free trials or beta features from time to time. Trial and beta features are provided on an "as is" basis, may change or end at any time, and may have reduced support or functionality.

3. Privacy and Other Policies

Our Privacy Policy explains how we collect, use, and disclose information in connection with the Services. Additional product-specific policies may apply where provided.

4. Rights We Grant You; Restrictions

4.1 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Services for your internal business use.

4.2 Restrictions

You may not:

  • Use the Services for unlawful, deceptive, abusive, or fraudulent activity.
  • Impersonate others or misrepresent identity, affiliation, or caller information.
  • Transmit spam, bulk unsolicited messaging, or unlawful robocalls.
  • Upload or process data without required rights, permissions, or consent.
  • Reverse engineer, decompile, disassemble, or attempt to extract source code.
  • Interfere with, overload, or disrupt the Services or related systems.
  • Bypass security, rate limits, or access controls.
  • Use bots, scrapers, or automated extraction tools without written permission.
  • Use the Services in a way that violates third-party provider terms.

5. Ownership and Content

5.1 Ownership of the Services

The Services, including software, interface design, trademarks, and related intellectual property, are owned by Bunta AI or its licensors and are protected by applicable law.

5.2 Your Content License

You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, and display your Input and Output solely as needed to provide, secure, maintain, and improve the Services and to comply with legal obligations.

5.3 Feedback

If you provide feedback or suggestions, you grant us the right to use them without restriction or obligation to you.

6. Third-Party Services and Materials

The Services may integrate with or rely on third-party providers, including telephony, calendar, cloud, and AI model providers. Your use of third-party services may be subject to separate terms and policies.

We do not control and are not responsible for third-party services, availability, model behavior, or external content.

7. Disclaimers, Limitations, and Indemnification

7.1 Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant uninterrupted availability, specific performance levels, or the accuracy of AI-generated Output.

7.2 Limitation of Liability

To the maximum extent permitted by law, Bunta AI and its affiliates, officers, employees, and partners are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising from or related to the Services.

Our total liability for any claim arising out of or related to the Services will not exceed the greater of (a) $100 or (b) the amount you paid to us for the Services in the six (6) months before the event giving rise to the claim.

7.3 Indemnification

You agree to defend, indemnify, and hold harmless Bunta AI from claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of:

  • Your use of the Services or Output.
  • Your Input or other content you provide.
  • Your violation of these Terms or applicable law.
  • Your failure to obtain required consents or comply with communication laws.

8. Arbitration and Class Action Waiver

8.1 Informal Dispute Resolution First

Before filing arbitration or litigation, you and Bunta agree to attempt in good faith to resolve disputes informally. You can contact us at support@bunta.ai.

8.2 Arbitration Agreement

Except for disputes eligible for small claims court, intellectual property disputes, or claims seeking only injunctive relief, disputes will be resolved through binding individual arbitration rather than in court.

8.3 Class Action Waiver

To the fullest extent permitted by law, all disputes must be brought only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding.

8.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to support@bunta.ai within 30 days of first accepting these Terms.

9. Additional Terms

9.1 Updates to These Terms

We may modify these Terms from time to time. If changes are material, we will provide reasonable notice. Continued use of the Services after the effective date of updated Terms constitutes acceptance.

9.2 Suspension and Termination

We may suspend or terminate access to the Services at our discretion, including for violations of these Terms, legal risk, abuse, non-payment, or security concerns.

9.3 Export and Sanctions Compliance

You agree not to use, export, or re-export the Services in violation of applicable export control or sanctions laws.

9.4 Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles, except where preempted by applicable federal law.

9.5 Entire Agreement; Severability

These Terms and our Privacy Policy are the entire agreement between you and Thinkit Labs LLC (d/b/a Bunta AI) regarding the Services. If any provision is unenforceable, the remaining provisions remain in effect.
